Heard Shri Karma Singh Yadav alongwith Sri Kuldeep Singh Yadav, learned counsels for the applicants, learned A.G.A. for the State and perused the material on record.
The instant Anticipatory Bail Application has been filed with a prayer to grant an anticipatory bail to the applicants, namely, Manoj Kumar and Shiv Kumar in Case Crime No. 54 of 2022, under Sections 147, 308, 323, 354, 379, 504, 506, IPC, Police Station - Barsathi, District - Jaunpur till the conclusion of trial after rejecting the anticipatory bail of the applicants by Sessions Judge, Jaunpur vide order dated 08.04.2022.
Learned A.G.A. submitted that in the present case, charge sheet has been submitted and maximum punishment for the aforesaid offences is seven years, therefore, applicants may move bail application through counsel in light of judgment of Apex Court in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another, Special Leave to Appeal (Crl.) No(s). 5191 of 2021 decided on 07.10.2021.
After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to file a regular bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of in terms of the decision rendered by the Supreme Court in Satender Kumar Antil (supra).
