Heard learned counsel for the revisionist as well as learned A.G.A.

The present revision is preferred to set-aside the impugned order dated 06.04.2022 passed by learned Special Judge(Gangster Act)/Additional District and Sessions Judge, Court No.11, Ghaziabad passed in Application No.16-Kha under section 311 Cr.P.C. dated 24.03.2022 passed in Sessions Trial no.88 of 2003(State VS. Nirdosh Tyagi and others) relating to case crime no.115 of 2003 under section 2/3 of Gangster Act, police station-Modinagar, District-Ghaziabad.

I have perused the order impugned and the application under section 311 Cr.P.C. is devoid of alleged questionnaire as contemplated in the judgment of Hon'ble the Apex Court in the case of Natasha Singh Vs. CBI reported in (2013) 5 SCC 741.

Hence, I do not find any illegality or perversity in the order impugned.

Accordingly, the present revision stands rejected.
