Heard learned counsel for the applicants and the learned A.G.A.

By means of this present application the applicants are seeking quashing of the entire proceedings of Case No.1321 of 2022, (State Vs Raj Kumar Nishad and others) under sections 323, 504, 308 I.P.C. including the charge sheet no.01/2020 dated 31.12.2020 arising out of Case Crime No.714/2020, Police Station-Jhangaha, District-Gorakhpur as well as cognizance and summoning order dated 10.1.2022 passed by the court of learned Civil Judge (S.D.) Court No.2, Gorakhpur pending in the court of Civil Judge (S.D.) Court No.2, gorakhpur.

Learned counsel for the applicants submits that the applicants are ready to appear before the Court concerned, file bail application and in case the bail application is filed, the same may be decided expeditiously.

In view of the above, prayers made in this application are rejected and this application is disposed of with the direction that in the event applicants surrender before the concerned court and thereafter files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
