Heard learned counsel for the petitioner and learned State Counsel.
By means of these proceedings instituted under Article 226 of the Constitution of India, a prayer has been made for directing the District Magistrate/Collector, Hardoi to take appropriate decision on the claim which is said to have been made by the petitioner under Krashak Durghatna Kalyan Yojana.
Accordingly, having regard to the innocuous prayer, the petition is disposed of with the direction to the District Magistrate/District Level Committee to take appropriate decision on the claim which is said to have been made under Krashak Durghatna Kalyan Yojana expeditiously, say, within a period of eight weeks from the date certified copy of this order is produced before the District Magistrate.
While considering the claim of the petitioner, the District Magistrate shall also take into consideration the plea of the petitioner based on the judgment of Hon'ble Apex Court dated 10.01.2022 passed in Suo Moto Writ Petition No. 3 of 2020, in Re: Cognizance for extension of limitation.
The petitioner while furnishing a certified copy of this order shall also submit the aforesaid order passed by the Hon'ble Apex Court dated 10.01.2022 to the District Magistrate concerned.
