Sri Sanjay Kumar Singh, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Moti against the judgment and order dated 24.12.1985 passed by 1st Additional District and Sessions Judge, Budaun in Sessions Trial No. 276 of 1984, Police Station Amanpur, District Kasganj.

As per office report dated 30.05.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 15.01.2022 informed that the appellant-Moti has died on 22.04.2021. In support of which a report of concerned police station and the copy of death certificate have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
