Heard learned counsel for the petitioner, Additional Chief Standing counsel for the State, Ms. Prateeti holding brief of Ms. Jyoti Sikka, Additional Advocate General for the State and Sri Ran Vijay Singh for the Secretary, Board of Basic Education.

Counsel for the petitioner contends that the petitioner's case is squarely covered by the judgment and order dated 27.5.2021 passed by this Court in Writ Petition No.11107 (S/S) of 2021 (Upasana Singh Vs. State of U.P. and others).

On the basis of the arguments and the averments made in the writ petition, the contention of the petitioner appears to be correct. Learned counsel for the respondents also do not dispute the said contention.

Accordingly, the present petition is also disposed of in terms of the aforesaid order and the petitioner shall be entitled to the benefit of the ratio laid down in the aforesaid judgment.

The office while issuing certified copy of this order shall also issue certified copy of the order order dated 27.5.2021 passed by this Court in Writ Petition No.11107 (S/S) of 2021 (Upasana Singh Vs. State of U.P. and others).
