The applicants have preferred the present contempt application for non-compliance of the final judgment and order dated 09.12.2020 passed in Writ (A) No.11386 of 2020 (Brahmdev Upadhay & 5 others Vs. State of U.P. & 2 others). The operative portion of the aforesaid order is quoted below:-
"....... In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case and with the consent of parties, this writ petition is disposed of finally with a direction to the respondent no.1 to consider the petitioners' representation and decide the same in accordance with law within a period of six weeks from the date of production of a copy of this order before him. "
Today when the matter was taken up, it is informed by Sri K.R. Singh, learned Standing Counsel appearing on behalf of the opposite party that vide order dated 14.07.2021 the State Government has already taken a decision in the matter. He has placed a photostat copy of the order dated 14.07.2021 before this Court and the same is taken on record.
In view of the above, no further orders are required to be passed by this Court in the present contempt application and the contempt application has become infructuous.
Accordingly, the contempt application is dismissed as having become infructuous.
