Perused the material brought on record.

By way of instant criminal appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 31.3.1989, passed by Ist Additional Sessions Judge, Bulandshahar in Sessions Trial No. 70 of 1985, Police Station - Sikandrabad, District - Bulandshahar, whereby the appellant has been sentenced to undergo imprisonment for life under Section - 302/149 I.P.C. and one and a half year rigorous imprisonment under Section - 147 I.P.C.

From the perusal of the report of Chief Judicial Magistrate, Bulandshahar, dated 26.09.2018, which is on the record of this case, it transpires that sole appellant - Mangal Sein @ Mangal had died on 06.10.2012.

In view of above, this appeal is liable to be dismissed as abated.

The present appeal is, accordingly, dismissed.
