The case is taken up through video conferencing.

Heard learned counsel for petitioner and learned Additional CSC for State.

With the consent of learned counsel for parties, this petition is being finally disposed of.

Learned counsel for petitioner contends that the petitioner was prosecuted in a criminal case under Sections 302/34 IPC at Police Station KadiPur District Sultanpur and was convicted and awarded life sentence with fine vide judgment and order dated 21.12.2020.

He also contends that the petitioner is in jail since 19.12.2020, however as the petitioner was in service he would be deemed to be under suspension yet he has not being paid suspension allowance.

He further submits that he may be given liberty to submit a representation before the appointing authority i.e. the Chief Medical Authority, District Sultanpur and the appointing authority be directed to decide the same in accordance with law within specified time.

To the said prayer learned Additional CSC has no objection.

Considering the aforesaid, it is provided that the petitioner may submit a representation for his grievance to the Chief Medical Officer, District Sultanpur within two weeks from today along with copy of this order and the Chief Medical Officer, District Sultanpur shall proceed to decide the same in accordance with law within a period of three months from the date of submission of the same.

Accordingly, the petition is disposed of.
