Heard Shri Balwant Rai, learned Counsel for the petitioner and Shri Anurag Verma, learned AGA for the State-respondents.

This writ petition has been filed by Irfan, seeking a writ of mandamus directing the respondent no.2-Supertintendent of Police, Hardoi to direct the respondent no.3-Station House Oficer, Mallawa, District Hardoi to register the case against the accused respondent nos.5 to 8 and investigate the matter. The petitioner also prayed for issuance of a direction in the nature of mandmus directing the respondent no.2 to take appropriate steps on thepetitioner's application and reminder dated 8.12.2020 and 2.1.2021.

Learned A.G.A. has drawn our attention towards the prayer made in the present writ petition. When a point query was made from the counsel for the petitioner regarding maintainability of the prayer made in the present writ petition, he could not give a satisfactory reply.

The learned AGA further pointed out that the controversy involved in the present matter has already been decided by this Court in similar matter in Misc. Bench No.24492 of 2020 : Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 dismissing the said petition, hence, the present petition be also dismissed in terms of the said order.

Accordingly, the present writ petition is dismissed with liberty to the petitioner to avail the appropriate remedy before appropriate Forum.
