Heard counsel for the petitioner.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to set aside the judgment and order dated 15.02.2020 passed by Additional District and Sessions Judge, Fast Track Court-II, Hapur in Revision No. 66 of 2018 (Mateesh Chand vs. Mahesh Chand and Others).
After some arguments counsel for the petitioner confined his prayer only to the effect that the court below namely Civil Judge (Senior Division), Hapur is directed to decide the Original Suit No. 563 of 2008 expeditiously.
It is stated that issue has already been framed in the matter.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division), Hapur to consider and decide the aforesaid suit in accordance with law expeditiously and preferably within a period of one year from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
