Civil Misc. Exemption Application No. 1 of 2021

Exemption application is allowed.

The appellant is exempted from filing the certified copy of the judgment dated 16.07.2021 passed by learned Single Judge.

Special Appeal

By this appeal, a challenge is made to the judgment dated 16.07.2021 passed by learned Single Judge by which the writ petition to challenge the order of transfer was dismissed finding it to be not in violation of any statutory provisions or suffers from malafides.

Learned Single Judge dismissed the writ petition referring the judgment of the Apex Court in the case of Mrs. Shilpi Bose and others Versus State of Bihar and others [AIR 1991 SC 532]. The violation of the transfer policy is not accepted to be a ground for challenge the order of transfer.

In view of the above, we do not find any ground to cause interference in the judgment of learned Single Judge.

Accordingly, the appeal fails and is dismissed.
