Order on Civil Misc. Exemption Application No.1 of 2021

Exemption Application is allowed.

The appellants are exempted from filing the certified copy of the order dated 03.03.2020 passed in Civil Misc. Writ Petition No.1834 of 2015 (Chhotey Lal Singh and others Vs. State of U.P. and others).

Order on Special Appeal

Both the parties have fairly admitted that the issue in this case has already been settled by co-ordinate Division Bench of this Court in the case of Umesh Rai and 5 others vs. State of U.P. Through Its Principal Secretary, (Forest Department) and 2 others passed in Special Appeal Defective No.293 of 2021 by the judgment dated 17.06.2021.

The appeal was dismissed finding no merit therein. In view of the aforesaid, this appeal is also ordered to be governed by the judgment passed in the case of Umesh Rai and 5 others vs. State of U.P. Through Its Principal Secretary, (Forest Department) and 2 others.

Accordingly, the appeal fails and is dismissed with the aforesaid.
