Heard Ms. Mohak Srivastava, learned Counsel for the petitioner and Mr. S.P. Singh, learned AGA for the State/respondents.

This writ petition has been filed by the petitioner, Govind Chauhan, seeking a writ of mandamus directing the respondents specially respondent no.2-Commissioner of Police, District Lucknow to immediately direct the concerned police to register the FIR under appropriate sections and suitable action against the culprits and also prays to issue direction to the respondents to provide the personal security to the petitioner and his family as the culprits who are the proprietor of the 'Educloud Educational Consultants' are highly influential persons and due to this, life and personal liberty of the petitioner and his family is in danger.

Learned A.G.A. has drawn our attention towards the aforesaid prayer made in the present writ petition and argued that the instant writ petition is not maintainable. He further pointed out that the controversy involved in the present matter has already been adjudicated and decided by this Court in identical matter in Misc. Bench No.24492 of 2020 : Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 dismissing the said petition, hence, the present petition be also dismissed in terms of the said order.

When a pointed query was made from the counsel for the petitioner regarding maintainability of the prayer made in the present writ petition, he could not give a satisfactory reply.

Accordingly, the present writ petition is dismissed with liberty to the petitioner to take legal recourse as provided under law as provided under law, if so desires.
