This Criminal Appeal has been filed against the judgment and order dated 17.07.2002 passed by Shri Arun Kumar Tripathi, learned Additional Sessions Judge, Fast Track Court, Firozabad in Sessions Trial No.289 of 1997 (State v. Arvind Kumar) under Section 307 IPC and the appellant was convicted under Section 324 IPC and directed him to furnish two sureties in a like amount of Rs.5,000/- before Probation Officer to keep peace for one year.
Office report dated 05.08.2021 indicates that vide report dated 06.04.2021 of Chief Judicial Magistrate-Firozabad, the sole appellant Arvind Kumar had died.
I have gone through the report of learned Chief Judicial Magistate-Firozabad dated 06.04.2021 which is according to the Circular Letter No.15/2005: VIIIb-119: Dated April 19, 2005 and Circular Letter No.04/Admin. G-ii dated: Allahabad 18.1.2017.
From the above record, it is proved that the sole-appellant Arvind Kumar had died, therefore, the appeal is abated.
The appeal is dismissed as abated.
