The writ petition was dismissed for want of prosecution on 17.04.2018.

The petitioner has applied for recall of the above order on the ground that case could not be marked and as such counsel could not appear before the Court. It has also been stated that the petitioner had no knowledge of the dismissal of the writ petition as no one was aware of the said dismissal.

The cause shown for the delay is held to be sufficient and since the absence is also explained, we condoned the delay in filing the recall application.

The Delay Condonation Application No.10 of 2018 as well as the Restoration Application No.11 of 2018 are allowed and the writ petition is directed to be restored to its original number subject to payment of cost of Rs.1,000/- which shall be deposited within two weeks' to be utilized for the benefit of litigants.
