Learned counsel for the applicant pointed out that in this case informant Pintoo Mehra has been made an accused and the named accused have been exonerated by the Investigating Officer. The matter was transferred to C.B.C.I.D. for investigation but the order of transferring the investigation was stayed by this court, thereafter, the local police has submitted charge-sheet against the applicant and co-accused Pintoo Mehra.

According to postmortem report 14 gun shot injuries have been found on the body of the deceased. A detailed counter affidavit is required in the matter.

Learned A.G.A. prays for and is granted 4 weeks' time to file counter affidavit. Rejoinder affidavit, if any, be filed within one week thereafter.
