Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents.

Present petition has been filed with a prayer that the respondent no. 1-District and Session Judge, Court No. 10, Meerut be directed to decide Civil Appeal No. 41 of 2016 (Hans Kumar vs. Vijay Pal Rastogi and others) within stipulated period.

Learned counsel for the petitioner pointed out that the civil appeal in question is infact of the year 2013 and the same was transferred from this Court to the District Court in the year 2016. It has been further pointed out that only general dates are being fixed in the matter.

In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1 to expedite the hearing of the aforesaid case and decide the same, in accordance with law, expeditiously, provided there is no other legal impediment.

With the aforesaid observations/ directions, the present petition is finally disposed of.
