Heard learned counsel for the applicant and learned A.G.A. for the State.

The present 482 Cr.P.C. application has been filed by the learned counsel for the applicant to quash the entire proceedings of Special Case No. 497 of 2018 in pursuance of charge-sheet no. 01 of 2018, under section 135 Indian Electricity Act (Amendment) 2003 in Case Crime No. 0119 of 2018, Police Station Farrukhabad Kotwali, Fatehgarh pending in the court of Special Judge, E.C. Act, Farrukhabad as well as cognizance order dated 22.9.2018 passed by the Special Judge, E.C. Act, Farrukhabad.

Argument is that the applicant is willing to deposit the compounding fee and get the offence compounded.

This application is disposed of directing the applicant to deposit compounding fee within the period of one month and the court below shall pass appropriate order on the compounding application within the period of two months thereafter.

In case of failure of applicant to deposit the compoundable fee, the court below shall proceed with the case in accordance with law.
