It has been informed by Sri Sanjiv Agarwal, learned counsel for the defendants that Sri Dipak Seth, learned Senior counsel in this matter is not well today as he has been suffering from heart problem, therefore, if possible, the matter may be adjourned for today.

Sri Mohit Kumar, the Plaintiff No.2 himself has no objection if the case is adjourned for today on the ground of illness of Sri Dipak Seth. However, it has been suggested by Sri Mohit Kumar that one Sri Vineet Bakshi, learned counsel for the Plaintiff Nos.1 and 3 would be arguing in this matter but he has also suffering from breathing trouble, so he has sought atleast ten days' time to be recovered from that ailment. However, Sri Ashotosh Bajpai, Advocate has also put in appearance on behalf of Plaintiff Nos.1 and 3.

Sri Mohit Kumar has submitted that if this case is fixed for 24.04.2019 Sri Vineet Bakshi and Sri Mohit Kumar shall be attending the case on the said date.

Sri Sanjiv Agarwal, learned counsel has also suggested that if 24.04.2019 is fixed, he would have no problem but he has requested that on the next date since two applications are pending for disposal, so both the applications may be heard and decided on that date so that the witnesses, who have already been called vide earlier order of this Court, may be called and the matter may be proceeded finally and can be decided at the earliest.

Considering the aforesaid submissions of the parties, list this matter on 24.04.2019 as first case and if in any case, it is not listed as first case, even then, it shall be heard as first case.
