Heard Sri Prashant Kumar, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.

This petition has been filed by the petitioner with a prayer to quash the orders dated 25.6.2013 and 18.1.2018 passed by respondent nos.2 & 3 in S.T.No. 146 of 1977, under Sections 148, 149, 307/149, 302/149 I.P.C., Police Station Ghatampur, District Kanpur Nagar.

Learned counsel for the petitioner submits that the controversy involved in the present petition stands concluded vide judgment and order dated 28.1.2016 passed by Coordinate Bench in Crl. Misc. Writ Petition No.15151 of 2014. He further submits that the present writ petition may be disposed of in the light of the said judgment and order dated 28.1.2016. He next argued that the co-accused person has also preferred a Crl. Misc. Writ Petition No. 1005 of 2017 in which similar order was passed by this Court vide order dated19.1.2017, copy of which has been annexed at page-43 of the writ petition.

Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.

Considered the submissions advanced by learned counsel for the parties.

We dispose of this writ petition with the same directions subject to which Crl. Misc. Writ Petition No.15151 of 2014 was disposed of by another Bench of this Court vide judgment and order dated 28.1.2016.
