Case has been taken in the revised call.  None appears on behalf of the appellants.

Sri Vaibhav Ojha, Advocate is present for the complainant.

Vide order dated 27.4.2018 the appellants Ram Sajiwan Pandey, Brijesh Pandey and Ghanshyam Pandey were granted a short term bail in order to enable them to attend a marriage ceremony in the family.  The short term bail was to last till 9th May, 2018 on which date the appellants had been directed to surrender before the Chief Judicial Magistrate concerned.

The office report dated 14.5.2018 and 18.5.2018 nowhere indicates any such compliance report from the Chief Judicial Magistrate nor the counsel for the appellants is present before the court.  Thus, there is no information before this court about the surrender and custody of the appellants in terms of the order dated 27.4.2018.

The Chief Judicial Magistrate, Basti is, therefore, directed to submit a report in this regard and in the event the appellants have not surrendered they shall be taken into custody forthwith in terms of the order dated 27.4.2018.

List after two weeks.
