Request on behalf of the counsel for the petitioner has been made for the case to be passed over, which is opposed by Sri I.R. Singh, counsel for the respondent.
The petitioner has challenged the order of termination dated 08.11.1994 passed by the Committee of Manager Jamia Asariya Darul Hadees, District Mau.
The respondent no. 5 Sri Maqsud Alam has filed counter affidavit, stating therein that after the termination order, the petitioner has been appointed in the several Institutions and writ petition does not survive. He submits that no rejoinder affidavit is filed till date.
In view of the fact averred in the counter affidavit, one week and no more time is granted to the petitioner to file rejoinder affidavit to the counter affidavit of respondent no. 5.
List the matter peremptorily in the next cause list.
