An application has been filed by the petitioner seeking recall of order dated 15.12.2010 by which the writ petition was dismissed as infructuous.

An application for impleadment has been filed by the Committee of Management of the institution  in which it is stated that now the institution is being managed by the duly elected Committee of Management and not by the Authorised Controller.

This fact has not been disputed by learned counsel for the petitioner before this Court.

Accordingly,  this Court is of the opinion that the Committee of Management is required to be heard in opposition to the application seeking recall of order dated 15.12.2010.

A supplementary affidavit has been filed today, which is taken on record.

List in the next cause list, by which date, counter affidavit, if any, be filed by the Committee of Management to the restoration application.
