Heard learned counsel for the appellant and learned counsel for the respondents.
This revision has been preferred against the order dated 28.01.2013 passed by the Principal Judge Family Court, Kanpur Nagar, in Case No. 508 of 2009 - Smt. Harshpreet Kaur Vs. Jaspreet Singh, under Section 125 Cr.P.C. Police Station Nazirabad, Kanpur Nagar.
Learned counsel for the revisionist contended that revisionist has meagre salary and can not afford to pay maintenance of Rs. 8,000/- per month as directed by the trial court. He has tried to show evidences regarding his paltry income. The impugned order has been passed after considering superficially of the fact, but since this order relates to interim maintenance, therefore it is out-rightly not being interfered by this Court at this stage.
The original case relates to year 2009. Much time has already been passed. Since then revisionist had to pay maintenance which may be much higher. Therefore this revision is disposed of with direction that if the original case is not decided within six month from the date of presentation of certified copy of this order then the trial court will reconsider the amount of maintenance, if the application in that regard is moved on behalf of the revisionist.
Certified copy of this order be communicated to the trial court.
