Heard learned counsel for the applicant and the learned A.G.A, for the State.
The applicant along with two others is charged for transporting illicit liquor for sale in U.P.
The submission is that the applicant was simply a passenger and has no connection with the goods which were being carried in the tanker or the foreign liquor which was found in the said tanker.
The one of the accused from whom the recovery of hologram was said to have been made was granted bail on 6.6.2016 and that the case of the petitioner is on better footing as no such thing except a marker pen was recovered from him.
In view of the above, let the applicant Harvinder Singh involved in Case Crime No. 231 of 2016 under Section 420,467,468,471 IPC and 60/72 Excise Act P.S. Majhola District Moradabad be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
The trial court before accepting the personal bond of the applicant shall record the photograph of the applicant and his proof of identity for verification, if necessary, on future dates when the applicant appears in the court.
The identity, status and residence proof of the sureties be verified by the authorities concerned before they are accepted.
In case of any breach of any of the above conditions, the trial court will be at liberty to cancel the bail.
