Rajiv Kumar And 6 Ors vs State Of U.P. And 4 Ors on 23 September, 2014
Bench: Rajan Roy

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 59

Case :- WRIT - A No. - 51620 of 2014

Petitioner :- Rajiv Kumar And 6 Ors

Respondent :- State Of U.P. And 4 Ors

Counsel for Petitioner :- Amrit Raj Chaurasiya,Pradeep Kumar Sharma

Counsel for Respondent :- C.S.C.

Hon'ble Rajan Roy,J.

The petitioners, who are constables in Civil Police, were transferred to Government Railway Police by order passed in the year 2011 for a period of three years. It is stated that the petitioners have completed the aforesaid period but they are not being sent back to their parent department, and hence the present writ petition.

After considering the submission made by learned counsel the petitioners, I am of the opinion that interest of justice would be served in permitting the petitioners to make individual representation for their repatriation to their parent department, before respondent no.3 alongwith certified copy of this order and in case, such representation is made, respondent no.3 shall decide the same in accordance with law expeditiously and preferably within a period of six weeks.

Subject to the aforesaid observations/directions, the writ petition stands disposed of.
