In the writ petition i.e. Writ A No. 40096 of 2014, protection for a period of six weeks or till disposal of the representation was given.
Petitioner's representation was decided immediately within a week and that was rejected. The only fact which is mentioned in the order impugned in this petition is that petitioner did not discharge his function properly and he remains absent..
Submission is that hardship of the petitioner which he is to suffer on account of his retirement which is due on 30th June, 2015, has not been taken into account.
Be as it may, taking into account the facts and totality of the circumstances, we permit the petitioner to continue at Gautam Budh Nagar, the place where he was working for a period of two weeks from today.
Let this petition be listed in the additional cause list of 25th September, 2014.
It is made clear that on the next date petitioner will file a supplimentary affidavit stating the work which he has executed during this period of two weeks duly certified by the concerned Presiding Officder.
Learned Standing Counsel is to file counter affidavit, if any, on or before the next date fixed.
