Heard learned counsel for the petitioner, Ms. Jyotsna Srivastava,  learned counsel appearing for respondent nos. 2 to 5 and learned Standing Counsel for respondent no.1.

By means of present writ petition, the petitioner has prayed for quashing the notification dated 23.05.2013 and notice dated 05.12.2013, issued by the respondent no.1(Annexure nos. 2 and 6 to the writ petition).

Learned counsel for the petitioner submits that by impugned notice the respondents had compelled the petitioner to fill up the form under the Employees State Insurance Corporation Act, 1948. 

He further submits that the institution of petitioner is recognized by Intermediate Education Act, 1921, therefore, the provision of Employees State Insurance Corporation Act, 1948 is not applicable on the petitioner institution. 

Matter requires consideration.

Ms. Jyotsna Srivastava, learned counsel for the respondents prayed for and is granted three weeks' time to file counter affidavit. The petitioner will have one week thereafter to file rejoinder affidavit.
