Heard learned counsel for the applicant and learned A.G.A.

This is second bail application. The Criminal Misc. First Bail Application No. 1048 of 2013 has been rejected by this court on 21.5.2013.

From the perusal of the impugned FIR and the statement of the deceased and other witnesses  recorded under section 161 Cr.P.C. the allegation against the applicant and  two other co-accused is that they entered into the house of the first informant  for committing the theft, the applicant was apprehended, then his associates caused injury on the person of the deceased and other persons for the purpose of releasing the applicant from the clutches of the deceased. It is a case in which no property has been stolen. The applicant is in jail since 17.8.2012, but the trial has not  been initiated. In such circumstances, the applicant is entitled for bail.

Let the applicant Sagar involved in  case crime NO. 550 of 2012 under Sections  382, 460 I.P.C., P.S.  Tulsipur, District Balrampur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the following grounds;

That the applicant shall not tamper with the evidence.

*That he shall report to the court of C.J.M. concerned in the first week of each month to show his good conduct  and behaviour till the conclusion of the trial.

In case of default, in any of the above mentioned conditions, the bail granted to the applicant shall be deemed cancelled and he shall be taken into custody forthwith.
