?Court No. - 35

Case :- WRIT - A No. - 34749 of 2014

Petitioner :- State Of U.P. And Another

Respondent :- Kashmir Singh And Another

Counsel for Petitioner :- Subhash Rathi

Hon'ble Sheo Kumar Singh,J.

Hon'ble Rajan Roy,J.

Argument is that in the appointment letter in respect to the relevant date there was some interpolation and on incorrect premises regularization was directed and therefore, that was liable to be withdrawn.

Submission is that  in the written statement and in the written argument all these aspects were clearly stated but the Tribunal  without considering all these aspects in most cursory and sketchy manner allowed the claim of the petitioner.

In view of the aforesaid, this court is satisfied that matter needs disposal on getting response from the respondents.

Issue notice to respodnent no. 1. Steps will be taken within a week.

List immediately after service.

On the facts, we direct that till the next date of listing operation of the impugned order dated 26.9.2013 shall remain stayed.

Order Date :- 9.7.2014
