Heard learned counsel for the petitioner and Sri Sanjay Singh, learned counsel appearing for respondent no.3 and learned Standing Counsel appearing for respondent nos. 1 and 2.

By means of present writ petition, the petitioner had prayed for quashing the impugned recovery citation dated 10.07.2012 issued by the respondent no.2 (Annexure No.4 to the writ petition).

Learned counsel for the petitioner submits that initially the petitioner has taken loan for agriculture purpose on 24.03.2009 from Panjab National Bank, Branch Jalilpur, Bijnor, and thereafter, towards the account no. 2212V32827 the entire amount was deposited on 01.06.2010. 

Learned counsel for the petitioner has also placed the original NOC issued by the Branch manager, Panjab National Bank, Branch Jalilpur, Bijnor, which also indicates that entire amount has been deposited by the petitioner on 01.06.2010.

The matter requires consideration.

Learned counsel for the respondent-Bank prays for and is allowed three weeks' time to file counter affidavit. The petitioner will have one week thereafter to file rejoinder affidavit.

List this matter after four weeks.

Until further order passed by this Court, no coercive action shall be taken against the petitioner, in pursuance of the recovery citation dated 10.07.2012, passed by the respondent no.2.
