Pursuant to the order of this Court dated 14.3.2014 a counter affidavit has been filed on behalf of opposite party no.1 but neither the order of the writ court has been complied with and affidavit of compliance has been filed nor the opposite party no.1 is present before the Court.

Sri Satish Chaturvedi, learned cunsel for the opposite party submits that due to some confusion he is not present before the Court.  List this case on 12th May, 2014. On that date opposite party no.1 shall remain present before the Court.  He also submits that an application for recall of the order of the writ court has been filed which is still pending.  Sri Kamlesh Kumar, Branch Manager, State Bank of India, Maudaha Branch, district Hamirpur is present before the Court.  His application seeking exemption from appearance on the future dates shall be considered on the next date fixed.  He shall also appear before the Court on the date fixed.

Learned counsel for the applicant prays for and is allowed one week's time to file reply to the counter affidavit.
