Pursuant to the order of this Court dated 13.3.2014 Sri Pankaj Saxena, learned standing counsel has filed a short counter affidavit sworn by Sri Sarvesh Kumar Srivastava, Executive Engineer, Irrigation Construction Division-5, Jhansi. It has been stated in paragraph 8 of the affidavit that against the order dated 17.5.2013 passed in Writ Petition No. 65917 of 2009 a Special Leave Petition (Diary No. 12681) of 2014) has been filed before the Apex Court which is pending. A prayer has been made to defer the hearing of the present contempt application till final adjudication of the special leave to Appeal.
The plea adjournment of the opposite party merely on the basis of pendency of the special leave petition is nothing but only a face saving device. Taking note of that, list this case on 23rd May, 2014. By that time in case no interim order is presented, passed in the aforesaid special leave petition and the order dated 17.5.2014 is not complied with the opposite party shall remain present before the Court.
