Under the order passed by this Court, appellant Dinesh @ Deena was examined for determining as to whether he is a juvenile or not. Juvenile Justice Board, Orraiya has dispatched us a communication dated 6.4.2013 wherein it has been mentioned that on 2.4.2013 aforesaid appellant Dinesh @ Deena has been declared to be a juvenile. Along with the said recommendation neither the order determining the aforesaid appellant to be a juvenile was sent to us nor the material and evidences taken by Juvenile Justice Board for reaching such a conclusion has been sent.

In absence of the above, it is difficult for us to hold that appellant is a juvenile.

We, therefore, direct to Juvenile Justice Board, Orraiya to send complete  photocopy of the entire material under the seal and signature of Principal Judge, Juvenile Justice Board to this Court in a sealed covered forthwith.

This order is directed to be communicated to Juvenile Justice Board, Orraiya by the Fax today itself through District Judge, Orraiya .

This matter is directed to come up again 21.5.2013 Juvenile Justice Board, Orraiya is directed to dispatch the material referred to herein above by the next date positively.
