Heard learned counsel for the petitioner and the learned Additional Government Advocate.

The petitioner, who happens to be complainant of case crime no.349H of 2012 under sections 419,420,467,468,471,504,506 I.P.C., police station Krishna Nagar, district Lucknow has approached this Court with the prayer that a direction may be issued in the nature of mandamus directing the opposite parties to investigate the matter in correct perspective, which, as alleged, they are not doing.

In view of the law laid down by the Hon'ble Supreme Court in the case of Sakiri Vasu vs. State of U.P. and others reported in 2008 (1) SCC (Criminal) 440 the petitioner has right to approach the Magistrate concerned having jurisdiction.

In view of the above, the writ petition is dismissed being misconceived.
