The petitioner is challenging the order of the District Judge, Bulandshahar dated 5.2.2011 by which the suit filed by the respondent has been transferred from Bulandshahar to Khurja.

The contention of the petitioner is that the respondent himself filed a suit at Bulandshahar. The petitioner resides at Meerut along with two minor children and her husband has died. The suit is for specific performance. The Bulandhshahar is about 50-60 kilometers from Meerut while Khurja is about 80-85 kilometers from Meerut. The petitioner has filed objection before the District Judge, Bulandshahar stating the aforesaid facts but without considering the difficulty of the petitioner, the impugned order has been passed.

Prima facie, the submission of the petitioner has a substance and requires consideration.

Issue notice to respondent. The petitioner is directed to serve the respondent by dasti summon and file an affidavit of service.

List this matter on 24.3.2011.

Till the next date of listing, the operation of the order dated 5.2.2011 passed by the District Judge, Bulandshahar shall remain stayed.
