Heard learned counsel for the applicants, learned AGA and perused the record.
It is contended by the learned counsel for the applicants that the prosecutrix Reshama had herself gone with the co-accused and performed marriage in Arya Samaj Mandir. According to the medical report, she was major. According to her statement recorded under section 164 Cr.P.C., she went along with co -accused Pintu on 19.2.2011 and performed her marriage with him on 20.2.2011. There is no allegation of rape. Prayer for bail of co-accused Ramwati and Anju has already been allowed by this court. It is further contended that the applicants are in jail since 29.6.2011, therefore, in the aforesaid facts and circumstances, they are entitled for bail. If the applicants are released on bail, they will not misuse the liberty of bail and will co-operate with the trial.
Learned AGA opposed the aforesaid prayer.
Considering the submissions of learned counsel for the parties, without expressing any opinion on the merits of the case, I consider it a fit case for bail.
Let the applicants Raghu Nandan and Neetu involved in case crime no. 47 of 2011, under sections 363, 366 IPC, P.S. Gonda, district Aligarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
