June 22, 2019:

A conductor with Tamil Nadu State Transport Corporation (TNSTC), who was sacked 15 years ago on allegations of being irregular to work, has been reinstated in service & given Rs 20.67 lakh back pay after the intervention of the State Human Rights Commission (SHRC).

D Vanniaraj of Milavittan village in Tuticorin was working as a conductor at the Thiruvaikundam depot of TNSTC Tirunelveli. According to the petitioner, he was wrongfully dismissed from service in September 2004, by alleging that he was irregular to work. The transport corporation moved the labour department to approve his dismissal from service.

Apart from refusing to approve the dismissal, the joint commissioner of labour (conciliation) also issued an order in 2010 directing the corporation to reinstate him into service along with a compensation for all the benefits he lost over the years.

When Vanniraj approached TNSTC with the order, the officials sat on the petition & had never allotted any work for eight years, Vanniraj said in his petition to the SHRC submitted in September 2018. He said the behaviour of his employer was a human rights violation.

SHRC member D Jayachandran issued summons to the managing director & general manager of the Tamil Nadu State Transport Corporation (TNSTC), Tirunelveli division, to appear before the commission in October last year & subsequently directed them to adhere to the labour department’s orders.
