Brief Facts:

The petitioner, accused of transporting cows for slaughtering filed a petition before the court for the grant of bail.

Contentions of the Applicant:

The learned counsel appearing for the petitioner contended that the petitioner had been in custody for a long time and challan had been presented in the matter but nothing had been recovered from the possession of the petitioner and thus, he should be granted concession of regular bail.

Contentions of the Respondent:

The learned state counsel opposed the granting of bail to the petitioner and contended that the petitioner was also found to be involved in another case involving Arms Act and the Animal Cruelty Act.

Observations of the Court:

The court stated that the petitioner had misled the court by denying involvement in any other case and there is apparent concealment of registration of an earlier case against the petitioner and there is no explanation of the same. The court observed that the petitioner is not entitled to rely only on the ground that he concealed an important fact from the fact.

The court further observed that the allegations against the petitioner are very serious and includes slaughtering, throwing of stones at the complainant and ramming their vehicle against the vehicle of complaint when they tried to stop the.

The decision of the Court:

The court after considering the gravity of the offence and the fact that the petitioner tried to mislead the court did not grant bail to the petitioner.
