The Supreme Court recently comprising of a bench of Justices SK Kaul and MM Sundresh adjourned the hearing of writ petition filed by a Noida resident against the road blockade at Delhi-NCR border as part of the farm protests to January 2022. (Monicca Agarwaal V. Union Of India & Anr)
Facts of the case
A Noida resident Monicca Agarwaal had filed the plea in the Top Court & alleged that her travel to Delhi is taking two hours instead of the normal 20 minutes.
She had contended that despite the various directions passed by the Supreme Court to keep the to & fro passage clear (the road), the same had still not happened.
Being a single parent who has some medical issues, Agarwaal said that it has become a nightmare to travel to Delhi. The plea said she stayed & worked in Noida, but since she had a marketing job she had to travel frequently to Delhi.
Contention of the parties
Solicitor General of India Tushar Mehta requested that the matter be adjourned in view of "the changed circumstances". It may be noted that three farm laws, which were the subject matter of the farmers' protests, were repealed by the Parliament last week.
Courts observation & judgment
The bench accepting the request made by Solicitor General of India posted the matter to the second week of January 2022.
The Supreme Court also took grim view of the continued blockade of highways in Delhi-NCR due to farmer’s protests against the three agriculture laws and said that this can not be a perpetual problem.
Justice Kaul had told the farmers unions, "You may have a right to agitate in any manner but roads should not be blocked."
