Abhijit Gangopadhyay, J., in Calcutta High Court on Monday cancelled the appointment of 6 assistant teachers after observing that they had been illegally appointed in accordance with the illegal recommendation of the West Bengal School Service Commission (WBSCC).
Background:-
Md. Abdul Gani Ansari filed a plea in this Court that he got 66.67 marks, but was not called for counselling or got any appointment letter instead people who got lower marks than him have been offered jobs.
In regards to this, WBSSC filed an affidavit, after which it was established that Mr. Ansari’s allegations were true. To this, WBSSC filed that petitioner is not to be considered as he has scored less marks, also that the candidates appointed were approved due to a mistake.
Order:-
WBSSC’s claim was dismissed by the Court, according to whom, this was a 'planned unlawful activity,' not a mistake.
Declaring that an appropriate order will be passed later on, the Court directed the District Inspector of Schools to file a report in the form of an affidavit disclosing when were the vacancies reported to him and when were they sent to higher authorities
Justice Abhijit Gangopadhyay ordered cancellation of the appointment of 6 teachers stating that illegally recruited candidates have no legal right to be working as an assistant teacher in schools.
