A Single Bench of Calcutta High Court comprising Justice Abhijit Gangopadhyay dismissed the Plea filed by Petitioner who sought the compassionate appointment, stating that the mother of the petitioner is a teacher of a school and thus there is no immediate crisis faced by the family members.
Background:
This is a case of the compassionate appointment of Anindita Mandal after the death of her father when she was ten years of age. The mother of the petitioner is a teacher of a school. In the present petition, the petitioner prayed for a compassionate appointment.
Order of the Court:
Justice Gangopadhyay while dismissing the petition reasoned that the compassionate appointment is given to tie over the immediate crisis faced by the family members for the untimely death of the bread earner. It is not a case where the family is facing a crisis to arrange even two square meals as the mother of the petitioner is working. Hence, this court did not find any merit in this writ application.
At last, he concluded that prayer does not come within the policy of the state for compassionate appointments.
Accordingly, the petition was dismissed.
