About the Seminar

Justice has always been a nebulous concept while the Judiciary has been the repository of public faith in the access to justice. After the executive and the legislature fall short, when one fails to get his grievance redressed, the judiciary is the only hope which comes to one’s rescue. Time and over again, the Judiciary through its landmark judgments and judicial activism have proved that this faith is not misplaced. But while some consider the judiciary the sanctuary of reasonableness, there are others that consider it the sanctuary of escape clauses, loopholes and acquittals for want of evidence as it is not free from political influence. Many reasons are attributed to the same, inferring from that the Chief Justice of the Supreme Court is appointed by the President of the Indian State, and governments in power use this to appoint judges who share similar ideologies.

Usually the top three senior-most judges are considered for the post, however, there are examples when the Congress government overlooked this practice and appointed A.K Sinha, in 1973.

It is imperative to note here that the separation of powers is an integral part of the Constitutionalism of the country and in that light, the best way to guarantee responsibility by the Government towards its subjects. This Seminar calls upon for deliberation upon this grey area of interference taking into account whether steps to be taken to eliminate this would sound the death knell for the Indian Democracy or whether the same as long as done without ulterior motives of political gain and in the spirit of public interest.
