About IDIA
IDIA (Increasing Diversity by Increasing Access to Legal Education) is a pan- India movement that seeks to empower underprivileged communities by creating top-quality lawyers from within. Founded by Late Prof. (Dr.) Shamnad Basheer in 2010, the project is run by student volunteers from various law school, who travel across the length and breadth of the country to identify marginalized students with an aptitude for the study of law.
IDIA comprises around 20 state chapters, the Uttar Pradesh Chapter being one of them. The student volunteers led by the team leaders work tirelessly to realize the aims of IDIA in and around the state of Uttar Pradesh.
About The Leaflet
The Leaflet is an online news portal founded by the esteemed Indira Jaising and Anand Grover, senior lawyers at the Supreme Court. It is an acclaimed platform that covers a plethora of legal and political opinions. The Leaflet is deeply committed to independent journalism and hence, is a firm believer in democracy. Lucid writings pertaining to contemporary Human Rights Issues and various other constitutional debates can often be found on the portal.
About the topic
The idea that marital rape is a "controversial" idea reflects patriarchal norms in law and society. Since the enactment of the Indian Penal Code in 1860, when the exception was first introduced, lawmakers have debated if the law should protect (rape)acious husbands.
The question is: Does the exception legalize the patriarchal norm of tolerating rape in marriage? Is the issue of marital rape a western concept alien to Indian culture? Should the Constitution support such state-sanctioned violence against wives? If the exception is deleted, will the institution of marriage crumble, or will raped wives get redressal?
About the event
The Legal Services vertical of the IDIA UP Chapter in collaboration with The Leaflet is organizing a virtual Panel Discussion with Indira Jaising, (Senior Advocate, Supreme Court of India), Ashish Goel (Advocate, Supreme Court of India) and Dr. Kumar Askand Pandey (Associate Professor of law, Dr. Ram Manohar Lohiya National Law University) as panelists. The discussion will be moderated by Dr. Samreen Hussain (Assistant Professor of law, Dr. Ram Manohar Lohiya National Law University).
The virtual panel discussion will cover the aspect of Marital Rape, which has been subjected to legal challenges for a long time. The respected panelists, experts in their field, will be answering burning questions on the topic and sharing their valuable opinions and perspectives. At the end of the session, there will be a query session. This panel discussion would provide an excellent opportunity to understand the issue holistically.
