Theme: “Data Protection Laws: A Cross Jurisdictional Analysis”The Editorial Board of the RSRR invites submissions for the RSRR Blog Series on the theme “Data Protection Laws: A Cross Jurisdictional Laws”.
With the digitization of the majority of commodities and services, data has become the primary building block of life. To regulate the framework regarding Data, States are passing various Data Protection legislation. India has also made a draft Data Protection Bill, which was a result of the Srikrishna Committee Report.
Similarly, The European Union’s General Data Protection Regulations (Regulation (EU) 2016/679) aims to protect the data and privacy of the individuals residing in Europe. The new Directive aims to replace the old European Directive of 1995 and further provides for the harmonization of data privacy legislation across the EU while providing stringent penalties for breaches of privacy and data leaks.
It provides a uniform platform within Europe and is wide in its scope, which implies that it has to be complied with by every organization active in the EU. It expands the scope of the right to privacy and data protection rights of individuals. However, this also increases the compliance cost on such organizations, if they want to keep their business operations active in the EU.
GDPR has set an outline for data protection and this can be seen in similar legislation worldwide. The Personal Data Protection Bill, set to be tabled in the Indian parliament in its recent winter session, is based on similar lines as most of the Data Protection laws. Therefore, through the instant blog, a comparative analysis of various Data protection legislation is sought.
