About Maharaja Agrasen Institute of Management Studies

About Department of Law 

The Department of Law was established in 2017 by introducing a five-year integrated BALL.B degree course. Established as a unit of the Maharaja Agrasen Institute of Management Studies, the Department aims to provide quality education with a professional approach to the budding legal professionals. Entry to the five year course is through the rankings of the CLAT (Common Law Aptitude Test). There is a total intake of 120 students in BA LL.B. stream and 60 students in BBA LL.B stream every year. Higher education imparts in-depth knowledge and understanding so as to advance the students to new frontiers of knowledge. In order to open more avenues MAIMS, Department of Law introduced LLM (Master of Law) in Intellectual Property Rights from this year. The Department is equipped with requisite facilities like Moot Court, Legal Services Clinic, etc., as stipulated by the Bar Council of India. It has a mix of senior seasoned faculty as well as young and dynamic faculty.

 

About The International Conference

Intellectual property has increasingly assumed a vital role with the rapid pace of technological, scientific and medical innovation that we are witnessing today. Laws related to intellectual property, Technology and competition have co-existed for over a century. The first two provide exclusive rights and licensing authority to the owners, while the last, competition law, is aimed to mitigate the negative impacts of exclusivity granted under the first two. On the other hand, as IP is considered significant source for economic progress, any enforcement under competition law should be carefully structured to prevent stifling technological advancements, which frequently manifest themselves in the form of IP. In addition, IP and competition rules are increasingly significant in terms of joint ventures, mergers and acquisitions, cross licencing, patent pooling, and licencing in general in today's digitalization era. TRIPS also includes a provision on anti-competitive conduct in IPR licencing, which is reflected in a number of countries laws dealing with IPR and competition. Recent enforcement of competition law in the area of IPR, including standard essential patent in advanced nations has achieved substantial impact on the legal landscape for IPR owners. Licensing is a useful way to generate more profit, hence right holders should be encouraged to licence IP as openly as feasible. Both, at the end, are meant to promote competition, innovation, and economic prosperity. In addition, policymakers and enforcement agencies must be aware of the nexus between competition and IP law, particularly in light of emerging technical advancements like as machine learning, the IoT (Internet of Things), network technologies such as 4G and 5G, genetic engineering, and so on. On the basis of above background, this conference would cover the national and international issues and challenges by revisiting the synergies, tenets and practices followed under IPR, Technology and competition law.

 

Aims and Objectives

Innovation has always been a catalyst in a growing economy. The advent of fresh innovations gives rise to healthy competition at macro as well as micro economic levels. IP laws helps to protect these innovations from being exploited unlawfully. Also, innovation has a different protection in the area of cyberspace. Hence, this international conference will help to generate and increase understanding of the relationship between intellectual property (IP), technology and competition law and policy. It aims to bring together leading academicians, policy makers, researchers and research scholars to exchange and share their experiences and research results on all aspects in relation to the theme of this conference. This conference aims to:

  • Stimulate research and debate on contemporary challenges in digital market economy, digitalization and digital governance.
  • Develop a better understanding of competition, cyber law and IP Rights.
  • Create a close network among the academicians, researchers, students and industry so as to develop an environment for exchange of ideas between academia and industry.
  • Encourage the interdisciplinary field of Law and Economics.
  • Associate or to form joint projects with other institutions, universities, NGOs India or Abroad for promotion of research knowledge in the fields of IP laws, Competition and cyber laws.

 

Mode of Conference

  • The conference sessions will be organized in the hybrid mode - based on consent.
  • No TA DA will be given. Accommodations will be provided only with the payment of requisite charges.

Eligibility

Researcher and Research Scholars, Academicians, Students, Law Consultants, Corporate Counsels, Policy Makers and Economists, Law Attorneys, Patent Agents, Patent Litigators & Managers, IP Managers, Law Firms, Engineering & Technologies Companies, Professionals in Legal Domain related to various Technologies and Research & Development Professionals can submit their paper.

 

Paper Submission Guidelines

1. Last date for submission of full paper is September 20th, 2022 (Tuesday).
2. All papers must be submitted through EasyChair at
3. The full-length paper should not exceed 8000 words (exclusive of footnotes). It must have the abstract and details of the authors.
4. In case of co-authorship at least one author must attend the seminar to present the paper.
5. The main text should be in Times New Roman with font size 12 and spacing of 1.5.
6. Spelling: UK - except in quoted text, which will follow the original spelling.
7. Pages to be numbered - Bottom of the page,at the center - numbered as 1, 2, 3, etc.
8. Footnoting: Please ensure that the footnotes are formatted correctly and consistently, in accordance with APA 6th Edition with Times New Roman font size 10.
9. Style for headings - Chapter Title: All in caps, bold, centered.
10. Style for subheadings:

  • Level 1: Headline style - capital, bold, left aligned, underlined.
  • Level 2: Headline style - bold, italics, left aligned.
  • Level 3: Headline style - italics, left aligned.

11. Referencing & Citation style- APA 6th edition.
12. Plagiarism: All submissions must be the author's original and unpublished work. Similarity Index should not exceed 10%.
13.The paper must be submitted in word document (.doc or .docx) format only.
