'Serious Situation, Can't take chance', SC decided against resuming Regular Court hearing in view of COVID-19

On Wednesday, a seven-Judge Committee of the Supreme Court has decided against resuming Regular Open Court hearings in view of the serious situation on the COVID-19 pandemic front.

“The committee, headed by Supreme Court judge, Justice NV Ramana decided that courts cannot be opened for regular hearings. This is a serious situation and infection is spreading and chances cannot be taken,” a person with direct knowledge of the matter told.

Though this is not the final state of affairs as the Committee has disclosed that they shall meet by this month-end and decide on the further course of action after seeking Expert Opinion.

“Yes, we met yesterday (Monday) but will take a call by end June.", it stated.

"There is no question of opening up. But how to open up? In any case, we have vacations till July…will see after that,” a Supreme Court judge told.

The Judges said they were extremely sympathetic towards Lawyers who are not well off and facing crisis due distress on the economy as a result pandemic.

“Yes, it is very difficult for them, but these are challenging times,” said one of the Judges.

The Court has received concern from all around as the functioning of the Judiciary has been under microscope during the Lockdown period. 

The BCI has written to the CJI earlier confining limitations of Virtual Courts to privileged Lawyers only. Later, taking note of all the suggestions and complaints, the SC has sought joint consent of Advocates and Party in Person for resumption of physical hearing of the Court.
