‘3000 Bighas? Is this a joke?’ Gauhati HC questions massive land grant to Private Cement Firm

The Gauhati High Court has expressed serious concerns regarding the allotment of nearly 3000 bighas of land to Mahabal Cements for mining operations in Assam's Dima Hasao district. Justice Sanjay Kumar Medhi, in his oral observations, stated verbatim, "3000 bighas! The entire district? What is going on? 3000 bighas allotted to a private company? We know how barren the land is...3000 bighas? What kind of decision is this? Is this some kind of joke or what? Your need is not the issue...the public interest is the issue."

Counsel for Mahabal Cements argued that the land in question was barren and required for the company’s operational needs. However, the Court remained unconvinced and directed the authorities to submit records detailing the policy that allows such a massive allotment of land to a private entity.

The Court emphasized that Dima Hasao is a Sixth Scheduled District, where the rights and interests of tribal communities must take precedence. The Court also highlighted the environmental sensitivity of the area, particularly Umrangso, which is an ecological hotspot containing hot springs, a stopover for migratory birds, and diverse wildlife.

The matter has been listed for further hearing on 01.09.2025, pending the submission of the requested records.
