When a Litigant's Father calls the CJI's Brother to complain about a Court Order, the CJI questioned, 'Will He dictate us?'

On Wednesday, the Supreme Court strongly rebuked a litigant after it emerged that his father had allegedly contacted the brother of Chief Justice of India Surya Kant to question a judicial order. Calling the conduct unacceptable, the Court indicated that such actions strike at the independence of the judiciary and may invite serious consequences, including contempt proceedings.

The case arose from a plea filed by a man seeking minority reservation benefits after converting to Buddhism despite belonging to an upper caste background. The Bench had earlier expressed concern over the nature of the claim and sought clarity from the Haryana government on the framework for granting minority certificates in such cases. When the matter was taken up again, the Court was informed, through the CJI himself, about an attempt made by the petitioner’s father to reach out to his family member regarding the order, raising serious questions about interference with judicial functioning.

The Bench openly questioned the intent behind such conduct and warned of potential action. Expressing disapproval, the CJI remarked, “He calls up my brother and asks him how the Chief Justice of India has passed this order. Will he dictate us?” The Court further indicated that such behaviour could amount to misconduct warranting criminal contempt. While refraining from immediate action, the Bench directed the State to file its compliance report and cautioned that failure would require the Chief Secretary’s personal appearance, before adjourning the matter.

The matter is listed for further hearing next week.
